1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Linksy ("Company," "we," "us," or "our"). By accessing, browsing, or using our website and services (collectively, "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any part of these Terms, you may not use our Services. Your continued use of our Services signifies your acceptance of these Terms.

2. Eligibility & Account Requirements

2.1 Age & Legal Capacity

By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding contracts. If you are under 18, you may not use our Services.

2.2 Account Creation

To use certain features (selling content), you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain the confidentiality of your password
• Accept responsibility for all activities under your account
• Notify us immediately of unauthorized access

2.3 Account Suspension & Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, illegal, or abusive behavior. Termination may result in loss of access to your content and funds.

3. Seller Responsibilities & Content

3.1 Ownership & Rights

By uploading content to Linksy, you represent and warrant that:

• You own or have the right to sell the content
• The content does not infringe on third-party intellectual property rights
• The content complies with all applicable laws and regulations
• You have obtained all necessary permissions and licenses
• You grant Linksy a license to host, distribute, and facilitate sales of your content

3.2 Prohibited Content

Sellers may not upload content that:

• Is illegal, obscene, or violates laws in any jurisdiction
• Infringes on copyright, trademark, or intellectual property rights
• Contains malware, viruses, ransomware, spyware, trojans, or any other harmful or malicious code
• Promotes hate speech, violence, or discrimination
• Violates privacy or data protection laws

Violation of this section may result in immediate account suspension, permanent termination, withholding of pending payouts, and reporting to relevant authorities where required by law.

3.3 Accepted File Formats

Linksy accepts the following file types for upload. Files outside this list will be rejected automatically.

Maximum file size: 250MB per file. Linksy reserves the right to expand or restrict accepted formats at any time.

3.4 No File Scanning

Linksy does not scan, inspect, or verify uploaded files for malware, viruses, or harmful content. Sellers are solely and entirely responsible for ensuring that all files they upload are safe, legitimate, and free from malicious code.

By uploading files to Linksy, you represent and warrant that the files are safe for download and use by buyers. Linksy reserves the right to remove any content reported or identified as harmful, without notice.

4. Payment Processing, Fees & Payouts

4.1 Platform Fee

Linksy charges a platform fee of 7% on each completed sale. Sellers retain approximately 90% of the sale price. All payments are processed securely. By selling on Linksy, you agree to our payment processing terms.

4.2 Payout Schedule

Creator payouts are issued once every two weeks (bi-weekly). Earnings from completed sales are accumulated and paid out in a single transfer per payout period. To receive payouts, sellers must have a valid payout profile configured (PayPal, bank transfer, or Wise) in their account settings.

Linksy reserves the right to withhold payouts in cases of suspected fraud, active disputes, or policy violations pending investigation.

4.3 Payout Methods

Payouts are sent via PayPal, international bank transfer (IBAN/SWIFT), or Wise, as configured in your payout profile. Sellers are responsible for ensuring their payout details are accurate. Linksy is not liable for failed or delayed payments resulting from incorrect information provided by the seller.

5. Refunds & Disputes

Buyers may request refunds within 14 days of purchase if content has not been accessed. Once content is accessed, refunds are not available. See our Refund Policy for full details.

6. Limitation of Liability

Linksy is provided "as is" without warranties. We are not liable for indirect, incidental, or consequential damages arising from your use of our Services. Our total liability shall not exceed the fees paid by you in the 12 months prior to the claim.

Linksy is not responsible for the content, quality, safety, or legality of files uploaded by sellers. We do not endorse, verify, or guarantee any content listed on the platform. Any harm arising from downloaded files — including but not limited to data loss, device damage, or security breaches — is the sole responsibility of the seller who uploaded the content.

7. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of our Services constitutes acceptance of the modified Terms.
